Defendant Traveling Wrong Way on Street - $283,000.00

In December 2002, the 44 year old plaintiff was injured in a work related automobile accident. After the accident the plaintiff began to experience leg, knee, neck, back, and shoulder pain.

The plaintiff explained that during the accident he was hit by a motor vehicle that was traveling the wrong direction on a one way road. Even though the defendant admitted primary responsibility, there was some argument that the plaintiff was responsible in some way as well.

In August 2003 the plaintiff underwent surgery for injuries resulting from the accident. The surgery was meant to correct rotator damage to the left shoulder. In addition, the plaintiff also suffered a herniated disc, and underwent several treatments in order to control the pain and symptoms. As a result of the accident, the plaintiff was left with a rated permanency on his back of 25 percent A.M.A. Along with this, up to 20 percent of extremity function was lost due to the shoulder injury.

All in all, the plaintiff explained that his medical damages equaled $40,000.00. In addition, the plaintiff argued that he lost more than $100,000.00 due to a loss in earnings.

After mediation, the plaintiff's counsel settled on approximately $283,000.00.
