Will I Need to Go to Court for My Boston Personal Injury Claim?
Things are likely stressful enough after getting injured in an accident, and you’re probably rightfully worried about the possibility of going to court in order to recover the compensation you are owed. While trial is certainly a possibility, the good news is that it’s only required in a minority of personal injury cases.
Whether your injury involved a car accident or a slip-and-fall at the grocery store, odds are very good that your claim can be resolved through out-of-court negotiations.
A Strong Negotiating Position
The likelihood of court depends on how strong your case is. If the evidence is overwhelmingly in your favor and your losses and damages have been clearly documented and identified, the insurance company will likely either meet your terms or counteroffer until a satisfactory settlement amount is agreed upon. They aren’t going to want to go to trial and have to pay for court and attorney’s fees if they’re just going to lose the verdict in the end.
There are a number of things you can do to help yourself. Remaining under the care of your doctor until you’re fully recovered is paramount. You don’t want the insurance company to claim that your injuries are less serious than they are because you apparently didn’t need medical care.
Likewise, documenting any expenses created by your accident or injuries is also important. By keeping all your receipts and bills, you can make it much easier to prove the full amount of compensation you are entitled to.
If Trial Becomes Necessary
Sometimes the other side simply refuses to take your claim seriously. When this happens, going to court and seeking a court-rendered verdict could become your best option. Even then, sometimes setting an actual court date is what it takes to get them to negotiate honestly.
